AUGUSTA, Maine (WGME) — Friday marks the final deadline for Maine to ban transgender athletes from girls and women’s sports.

The U.S Department of Education's Office for Civil Rights issued an investigation into Maine over complying with Title IX. It's one of two separate investigations.

This all started when Maine Republican Rep. Laurel Libby posted unblurred photos identifying a transgender minor athlete from Greely High School, making her point that she believes trans athletes should not participate in girls’ sports.

The letter sent to Maine’s Department of Education is the final step in this Title IX investigation.

Gov. Janet Mills, the attorney general, and the Maine Principals’ Association, which governs high school sports, says they plan to follow state and federal law.

Gov. Mills says Trump’s executive order barring trans athletes from competing does not supersede the federal Title IX law or the Maine Human Rights Act, which not only recognizes trans athletes but prohibits discrimination against them.

It’s been about three weeks since the Office of Civil Rights provided the Maine Department of Education with a proposed resolution agreement to fix Title IX violations. If not, the Maine department risks enforcement.

The United States DOE claims that since the proposed resolution agreement was introduced, the Maine DOE has “taken no action to protect women and girls from discrimination in sports or intimate spaces.”

CBS13 reached out to the Department of Education and members of Maine’s delegation for comment on the issue, but we have not gotten a response yet.

At the high school level, only two trans athletes are competing in Maine during the current school year.

For 2023 to 2024, around 45,000 students participated in high school sports in the state, according to the Bangor Daily News.
