ALBANY, Ga. (WALB) — The Georgia Supreme Court has issued a stay until further order of the court.
This comes after Dougherty County Judge Victoria Johnson denied the request of a plea in bar on double jeopardy grounds.

The defense argued Embert’s constitutional rights were violated in the previous trial. That trial ended last Friday in a mistrial after excluded testimony was mentioned.
Jake Embert’s family said they have waited 11 years for justice.
The order says the state has until 4:30 p.m. on Thursday, Dec. 11, to file a response to the order.
