OAKLAND COUNTY, Mich. (WEYI) — The attorney for Jennifer Crumbley is asking for his client to be released from prison.
Michael Dezi, Crumbley's attorney says while her appeal is going through the court process she should be released from the Michigan Department of Corrections Women's Huron Valley Facility.
His motion filed Thursday with the Oakland County Circuit Court says Crumbley should be released on bond and says she is "not a flight risk."
Jennifer Crumbley was found guilty and later sentenced to 10-15 years in prison in connection to the Oxford High School shooting.
Her son shot and killed four people and injured seven others on November 30, 2021.
Jennifer and James Crumbley became the first parents to be convicted in relation to a school shooting.
Dezi in his motion says "At this point, Mrs. Crumbley has been in custody for over three years. Given the overtly tenuous nature of these charges, the prosecution should not reap the reward of a lengthy unlawful incarceration before the Michigan Supreme Court can hear and decide this case. By granting bond, with or without conditions, the prosecution stands to lose nothing while these substantial issues of law are decided with finality by the appellate courts."
Earlier this motion Dezi filed a motion in the court of appeals, appealing Jennifer's sentence.
He says her trial was filled with legal errors.
His motion was filed with the state's appeals court on December 2 saying, "Two of the prosecution’s key witnesses, Mr. Hopkins and Mr. Ejak, entered into cooperation agreements to testify against Mrs. Crumbley. Yet, the prosecution hid the existence of these agreements before and during Mrs. Crumbley’s trial. Mrs. Crumbley’s right to a fair trial was further denied when the jury was instructed that it could convict Mrs. Crumbley even without a unanimous verdict."
Dezi asked for a hearing next month in Oakland County in front of Judge Cheryl Matthews, the judge who presided over the case for both James and Jennifer Crumbley.
