(WBFF) — The Maryland House of Delegates has passed Senate Bill 828, which prohibits Immigration and Customs Enforcement (ICE) officials from entering sensitive locations such as schools, libraries, or churches without a warrant. The bill, which passed with 98 votes in the affirmative, is one step closer to becoming law.

The legislation also incorporates House Bill 1222, which aims to eliminate the 287(g) program. This program allows local law enforcement to collaborate with ICE on detainers. The amended bill proposes a statewide standard for local jails to hold individuals convicted of violent crimes or gang activity for 48 hours to facilitate ICE detainers. If ICE does not pick up the individual within that time frame, they must be released.

"People in my community have been afraid for far too long," Frederick County Delegate Karen Simpson said. "I am thankful to everyone in this body who has voted for this so that we can get rid of 287(g) who has scared our community."

However, Baltimore County Republican Delegate Kathy Szeliga, a longtime opponent of both bills, criticized the legislation.

"This is, I believe, more fear mongering by the left, that is stirring up the immigrant community," Szeliga said.

Szeliga added an amendment to include sex offenders, ensuring that criminal illegal immigrants on the sex offender registry would be turned over to ICE. This amendment passed but will not take effect until June 1.

The bill now returns to the Senate, which has until midnight Monday to vote on it.

"I hear that the Senate doesn’t love the bill the way it’s been amended. But I believe that they will pass this bill," Szeliga said.

If the Senate approves the bill, it will head to Governor Moore's desk for signature.

"It will not make Maryland citizens safer, unfortunately. But that is what we’re seeing coming out of Annapolis," Szeliga said.

Lawmakers face a Monday midnight deadline to cast their votes.
