(TNND) — A continued hearing was held Monday in a lawsuit involving Fulton County, Georgia, District Attorney Fani Willis, who is prosecuting an election interference case against former President Donald Trump and others.

Ashleigh Merchant, an attorney representing one of the defendants, accuses Willis’ office of violating the state’s Open Records Act.

Merchant accuses the District Attorney’s Office of failing to provide documents related to her client, Michael Roman, and alleges Willis benefited from the hiring of Willis’ former boyfriend as a special prosecutor on the criminal election interference case.

The lawsuit was filed last January. The special prosecutor, Nathan Wade, withdrew from the case in March.

The judge said at Monday’s hearing that the plaintiffs had rested their case during the previous hearing in offering evidence in an effort to demonstrate that the Open Records Act had not been complied with, and that left the issue of potential remedies sought by the plaintiffs remaining to discuss.

The county attorney's office represented the defense in the hearing. Willis was not shown during a livestream of the hearing.

Merchant was called to the witness stand by the defense.

Merchant said in testimony that she doesn’t believe she’s received all requested non-disclosure agreements in the case.

She discussed the number of open records requests she’s made, estimating it’s been under 20 in the last year.

“I did open records, and then I got a hearing. When I got that hearing, I was able to issue subpoenas for those same things that I’d been denied in open records. I was able to get them, because I could issue a subpoena in that hearing. I could not, however, issue a subpoena to things that weren’t relevant to that hearing, which is why this open records lawsuit has continued,” Merchant said.
