U.S. Attorney General Pam Bondi will announce enforcement actions against Maine on Wednesday for violating Title IX.

This comes after Maine said it would not comply with the federal government's demands to ban transgender athletes from girls’ sports, a move that would violate state law.

“You better comply because otherwise you’re not going to get any federal funding,” President Donald Trump said during a February event.
“We’ll see you in court,” Gov. Janet Mills responded.
“Good, I’ll see you in court. I look forward to that,” Trump replied.

Supporters of Trump’s executive order argue it protects the integrity of women’s sports under Title IX, which a federal law prohibiting sex-based discrimination.

Maine officials say they have no intention of complying, citing the Maine Human Rights Act, which protects against discrimination based on gender identity.

Although Mills recently said the state’s athletic policy is “worthy of debate,” she has continued to challenge the larger legal issue, that an executive order does not supersede state law.

“This is about the rule of law,” Mills said. “It’s about who makes the laws — which is the Legislature and the Congress — and who enforces and executes the laws, which is the chief executive. It’s as simple as that.”

The Trump administration has threatened to pull federal education funding, claiming Maine’s policy is in violation of Title IX.

However, Maine Attorney General Aaron Frey disagrees. His office wrote in a letter that nothing in Title IX prevents transgender athletes from playing on girls’ teams and cited several federal court cases supporting the state’s position.

But legal or not, any funding pause puts Maine’s budget in limbo.

Attorney General Bondi is holding a news conference at 8:15 a.m. on Wednesday to announce what enforcement actions will be taken against Maine.
