NASHVILLE, Tenn. (WZTV) — Kilmar Abrego Garcia, indicted on multiple charges including human smuggling in Tennessee, will continue to be held in federal custody.
Though the judge stated that Abrego Garcia will be held without bond until Friday, his attorneys stated that they fear he would be taken immediately into ICE custody and possibly deported.
If ICE releases Abrego Garcia, he would be placed on home detention at his brother’s residence.
Abrego Garcia will have his location monitored and be limited to the Middle District of Tennessee and the District of Maryland, likely where he will be reporting regularly for pretrial services. He will be limited to only attending work, court appearances, or religious services.
He will not be able to have any direct or indirect contact with co-defendants, witnesses, victims, and cooperating individuals named during the hearing.
Additionally, he must have no contact with any known members of the MS-13 gang.
As part of his release conditions, Abrego Garcia is required to undergo a mental health evaluation and participate in anger management counseling, as well as any other counseling mandated by Pretrial Services.
Abrego Garcia is required to seek or maintain employment and surrender any passports as directed.
Other prohibitions in place include no possession of firearms or destructive devices, being present in any home or vehicle where firearms are located, or using narcotics unless prescribed. Excessive alcohol use is also prohibited, and he will be subject to random drug testing to monitor compliance.
Both the defense and prosecution have until 5 p.m. Thursday to file written briefings. After that, the judge will issue a written ruling, deciding whether Abrego-Garcia will be released into ICE custody.
