Murdaugh retrial 'not likely' following Becky Hill charges, former SC AG says

Description

COLLETON COUNTY, S.C. (WCIV) — More than two years after Alex Murdaugh was found guilty of murdering his wife and son, the clerk of court who oversaw the trial was arrested.

Becky Hill, the former Colleton County clerk of court, is facing four felony charges of perjury, obstruction of justice and misconduct in office. She went before judges in Colleton and Richland Counties Wednesday for the respective bond hearings and was ultimately granted personal recognizance bonds and allowed to go home without paying.

In Colleton County, Hill is facing two charges of misconduct in office and accused of using her public position to promote her book on social media, and of unlawfully pocketing thousands of dollars in bonuses and a check.

According to South Carolina Law Enforcement Division documents, Hill requested and received $9,880.10 in financial bonuses from Title IV-D Incentive Funds, federal funding that’s used for child support services. Hill is also accused of receiving a $2,000 check using funds from her clerk of court office shortly before she resigned.

“She turned herself in. We found out about these charges last night. We're here right now,” Will Lewis, Hill’s attorney, said in a bond hearing Wednesday.

SLED documents also accuse Hill of showing sealed evidence photos to a third party during Murdaugh’s double murder trial in 2023.

Former South Carolina Attorney General Charlie Condon called it a serious offense, but one he thinks likely had little impact on the jury.

“It could not have affected that verdict whatsoever, there was so much information flowing around the time, and jurors were instructed very clearly not to look at media,” Condon told News 4 Wednesday.

Hill faces one perjury charge in Richland County which stems from the jury tampering allegations Murdaugh’s legal team pushed following his guilty verdict.

Hill is accused of lying to former South Carolina Chief Justice Jean Toal about showing sealed evidence to third parties during a hearing in January 2024.

Toal ultimately denied Murdaugh a retrial based on the jury tampering allegations. Still, she showed some reservations.

“I find that the clerk of court is not completely credible as a witness,” Toal said in the hearing.

Despite the serious allegations, Condon said one thing is notably missing from the list of charges announced against Hill Wednesday.

“There's nothing in here about jury tampering. So, I would think that SLED investigated these allegations and didn't find sufficient proof to charge her,” Condon said.

Jury tampering has been the focal point of Murdaugh lawyers Jim Griffin and Dick Harpootlian’s request for a retrial.

“I’m assuming SLED talked to all the jurors. I'm assuming SLED ran down all the evidence that's out there,” Condon added, “Not charged.”

News 4 reached out to SLED Wednesday for more clarification on jury tampering allegations being investigated and has not heard back.

So, what could Hill’s arrest mean for Murdaugh’s hopes to plead his innocence again? Condon doubts a retrial is likely.

“I think the likelihood of the case being reversed on appeal is not high. There is a chance of it, but I don't think it's particularly high,” he said.

But Murdaugh’s attorneys see Hill’s perjury charge, lying to Judge Toal, as a possible open door.

“This perjury count is an accusation by the state that they can prove beyond a reasonable doubt that she lied during that proceeding. And if she lied during that proceeding about one thing, it certainly challenges her credibility on any other thing,” Dick Harpootlian said on Fox News Wednesday.

Hill is expected to be back in court on July 18 in Colleton County, then again on July 25 in Richland County.

Condon expects her to waive both first appearances.
