NASHVILLE, Tenn. (WZTV) — Kilmar Abrego Garcia, who made national headlines after being deported from Maryland earlier this year and sent to prison in El Salvador, is set to appear in a Nashville court Friday.
A federal judge will decide whether he will remain in custody or be released ahead of his trial on human "smuggling" charges.
Abrego Garcia, who entered the United States illegally, was initially allowed to stay, claiming he would face violence from gangs if he returned to El Salvador. The Trump administration alleged he was involved with the violent gang MS-13.
His defense team is requesting his release, arguing that he did not receive due process before his deportation in March. Federal prosecutors, however, contend that he is a flight risk due to his status as an undocumented immigrant.
Abrego Garcia was deported to a prison in El Salvador, sparking national protests. Last week, federal officials brought him back to the U.S. to face charges in Tennessee. The charges stem from a 2022 traffic stop where Tennessee Highway Patrol troopers suspected human trafficking. Officials now allege that Garcia participated in a human smuggling operation and he is charged with the unlawful transportation of illegal immigrants.
