ALBANY, Ga. (WALB) - On June 10, the Georgia Supreme Court released a decision on the dismissal appeal that was made in the Susan Embert case.

WALB previously reported that in 2014, Susan was charged in Dougherty County with killing her husband, Jake Embert. Then, in 2019, Susan was found guilty on all charges.

Back in May 2024, a motion of dismissal in Susan’s case was granted in Dougherty County.

According to court documents, the State of Georgia appealed the trial court’s order dismissing its case against Susan on “constitutional speedy trial grounds.”

“We hold, for the reasons stated below, that the trial court erred in finding that Embert’s December 2019 trial was void and could not be considered for purposes of the speedy trial calculation. Accordingly, we vacate the dismissal order and remand the case to the trial court for reconsideration of its speedy trial analysis in light of this ruling.”
