Description

DALTON, Ga. — The Dalton college student who has spent almost a week at an ICE detention facility has now learned when she'll next appear before a judge.

The attorney for 19-year-old Ximena Arias-Cristobal told us via email on Monday that her bond hearing has been set for Tuesday, May 20th.

At that hearing, there is a chance Arias-Cristobal could be released on bond. Her case would then be transferred to a non-detained immigration court, and a new hearing date would be set, according to Dustin Baxter of Kuck Baxter Immigration attorneys.

Baxter says that hearing would likely happen "a year or two from now."

Our reporting on Arias-Cristobal's case made national headlines last week.

On Monday, a Dalton Police officer stopped her after she turned right on a red light, in front of a 'no turn on red' sign.

A police report says the officer discovered that Arias-Cristobal did not have a U.S. driver's license.

Not only that, they learned Arias-Cristobal is not a U.S. citizen. She came to this country illegally with her parents when she was 4 years old, and has lived her life in the Dalton area ever since.

She graduated from Dalton High School, and was attending Dalton State Community College at the time of her arrest.

2 days after that arrest, she was shackled and transported to a detention facility for Immigration and Customs Enforcement (ICE) in southwest Georgia.

Arias-Cristobal's father is also at that detention facility. A traffic stop led authorities to detain and arrest him 2 weeks ago.

Arias-Cristobal's attorneys told us they did not have any updates on his case, as another firm is working to represent him legally. But Baxter did tell us "Ximena and her father have very different cases."

On Thursday on its social media pages, the Department of Homeland Security said of the cases Arias-Cristobal's case, "The family will be able to return to Mexico together."

This is a developing story. Depend on us to bring you updates as we get them.
