SAN FRANCISCO (TNND) — A federal judge will hold a hearing on Thursday over California's request to block the Trump administration from using the National Guard and Marines to help put an end to protests that were sparked by Immigration and Customs Enforcement (ICE) raids.

California Gov. Gavin Newsom and Attorney General Rob Bonta filed an emergency motion on Tuesday but were denied and scheduled to discuss the requested order in federal court in San Francisco.

The emergency motion would temporarily bar the Trump administration from using California's National Guard troops to enforce state laws and prohibit the National Guard from assisting with carrying out immigration raids.

"The federal government is now turning the military against American citizens. Sending trained warfighters onto the streets is unprecedented and threatens the very core of our democracy. Donald Trump is behaving like a tyrant, not a President. We ask the court to immediately block these unlawful actions,” Newsom said in a statement.

Since Saturday, President Donald Trump has deployed more than 4,000 National Guard members and 700 Marines to Los Angeles against the state's wishes. A top Pentagon official testifying before the House, Bryn Woollacott MacDonnell, estimated it will cost Los Angeles $134 million.

Trump cited a legal provision, allowing him to mobilize federal service members when there is “a rebellion or danger of a rebellion against the authority of the Government of the United States.”

The National Guard will remain in LA for 60 days, according to the memorandum the president signed deploying them, with Trump stating on Tuesday that they would remain until there is no danger.

Trump defended his decision by saying, "If we didn't send our National Guard and last night we gave them a little additional help, Los Angeles would be burning right now."

Newsom delivered a public address Tuesday night, calling Trump’s actions the start of an “assault” on democracy.

“California may be first, but it clearly will not end here. Other states are next,” he said. “What Donald Trump wants most is your fealty, your silence. To be complicit in this moment. Do not give it to him.”

The Marines have not yet been spotted in Los Angeles and Guard troops have had limited engagement with protesters.

Mayor Karen Brass imposed a nightly curfew covering a 1-square-mile section from 8 p.m. to 6 a.m. until the foreseeable future.

LAPD announced officers arrested more than 200 people on the first night of the curfew.

"During the crowd control situation, numerous less-lethal munitions were used," police said.
