FORT STEWART, Ga. (WTOC) - Former member of the Judge Advocate General corps A.J. Balbo, now a Hinesville Criminal Defense Attorney, spoke with WTOC about who, what, and how they will charge accused Fort Stewart shooter Sgt. Quornelius Radford.

He said it could be through the military system because Fort Stewart military police investigated the shooting, the victims are soldiers, and the Army will prosecute its own if they have an interest in doing so.

Or, it could be brought to the United States Attorney’s Office, as Fort Stewart is a federal installation.

At this time, with the information Balbo has, he anticipated on Thursday that Radford would likely face a Fort Stewart Court-Martial for his alleged acts on Wednesday.

As for Radford’s options, he is entitled to a military counsel free of charge right now. He can appoint a civilian attorney at his own expense, but they would then work in conjunction with the military counsel provided.

Balbo thinks, based on his experience, that the judicial system in this case would move fairly quickly.

But there is a major component to the entire case.

“The only thing that I think could delay something like this would be if there’s a question of having to do with his competency. If his mental health is maybe in doubt,” he said. “And, it’s so early, and obviously we don’t have any of that information, but that is one thing that I could see that could slow this process.”

Radford is currently in Liberty County Jail. Balbo said it’s not unusual for him to be held there because usually a service member arrested for longer than an evening goes there.

Radford is innocent until proven guilty.
