ALBUQUERQUE (TNND) — A 13-year-old boy has been arrested and charged with intentionally crashing a stolen car into a man riding his bicycle to work, killing him, New Mexico police announced Monday.

The shocking incident happened in May 2024, when 63-year-old Scott Dwight Habermehl was struck and killed while biking to his job at Sandia National Laboratory in Albuquerque. Police said the young suspects filmed the deadly collision and laughed as they carried out the act.

Detectives arrested 13-year-old Johnathan Overbay on multiple charges, including an open count of murder, conspiracy to commit murder, leaving the scene of an accident involving great bodily harm or death, and unlawful possession of a handgun by a minor. A second suspect, 15-year-old William Garcia, faces the same charges and is currently being sought by authorities. A third boy, 11 years old, is too young to be charged with murder, but officials are working with the District Attorney's Office and the Children, Youth and Families Department to determine what charges may apply.

Investigators revealed that the boys filmed themselves during the incident. In the recording, the driver, believed to be Overbay, can be heard accelerating the vehicle while discussing how to "bump" the bicyclist. "Just bump him, brah," one boy said. The driver replied, "Like bump him?" The passenger insisted, "Yeah, just bump him. Go like... 15... 20."

Moments before impact, the 11-year-old passenger — seen on video brandishing a handgun — ducked down, laughing, as the vehicle swerved into the dedicated bike lane on Moon St., fatally striking Habermehl. The disturbing video captured the sound of the impact as Habermehl and his bike were dragged along the vehicle's side.

The police department's fatal crash team initially investigated the incident but struggled to identify those involved. The case gained traction in February when an anonymous tip reported that a video of the crash had been posted on social media, linking it to a specific Instagram account.

Police stated that homicide detectives obtained search warrants for social media accounts and examined cell phones seized from Overbay and the 11-year-old during a separate investigation in June 2024. APD’s Digital Intelligence Team recovered several clips showing the teens, including footage of the fatal crash itself.

Overbay was taken into custody and booked into the Juvenile Detention Center. Authorities continue to search for Garcia and the 11-year-old.

"This was a deliberate and senseless act of violence," said APD Chief Harold Medina. "We are committed to seeking justice for Scott Habermehl and ensuring those responsible are held accountable."
