ATLANTA, Ga. (Atlanta News First) — The suspect in the death of a 4-year-old boy at a southwest Atlanta townhome has been charged with murder, according to police.

Colby Cooks was found dead Monday night at the Aviary Park townhome community on Cardinal Drive.

Cooks died from blunt force injuries, the Fulton County Medical Examiner said Wednesday. The medical examiner classified Cooks’ death as a homicide.

Officers responded to Aviary Park around 7:20 p.m. Monday for a welfare check. Inside, they discovered Cooks had been killed.

Jasmaine Smoak, 32, was arrested the next morning by the Wilkes County Sheriff’s Office.

Police said Smoak left the scene with three children before officers arrived. One of those children was hospitalized for injuries, according to Atlanta police.

Hours later, Atlanta police used license plate reader technology to track Smoak to Washington, Georgia – about two hours east of Atlanta – where Wilkes County sheriff’s deputies arrested her.

Smoak was initially charged with second-degree cruelty to children and concealing the death of another, police said.

Following the results of the autopsy, Atlanta police said Smoak was also charged with murder, aggravated assault and first-degree cruelty to children.

Authorities confirmed that Smoak is not related to the victim.

She remains in custody at the Wilkes County Jail as she awaits extradition to Atlanta, according to police.
