Description
ATLANTA, Ga. — A Georgia law requiring parental consent for children under 16 to make a social media account is no longer blocked, according to Attorney General Chris Carr.
SB 351 was passed by the General Assembly and signed by Gov. Brian Kemp in 2024. But NetChoice, a trade association representing major tech platforms, filed a lawsuit, arguing the law is unconstitutional.
In June 2025, the district court issued a preliminary injunction blocking enforcement of the law, which Carr appealed. The injunction was vacated by the U.S. Court of Appeals for the Eleventh Circuit on Thursday.
In a statement, Carr called the action a “major win.”
“We have said before — it shouldn’t take lawsuits, investigations or legislation to do the right thing,” he said. “This is about keeping our children safe from online predators and mental health harms. Nothing is more important.”
In its order, the appeals court said NetChoice didn’t prove the law is unconstitutional and also disagreed with the association’s claim that the law is too vague.
Now, the case has been sent back to the district court.
