ALBANY, Ga. (WALB) - The Albany Police Department (APD) is investigating a possible brake failure in a crash that caused a cement truck to overturn onto a car. The driver has not been charged, APD said.

According to the incident report, the driver told APD that his brakes snapped, and the truck was uncontrollable. The cement truck flipped over in the intersection of East Oglethorpe Boulevard and South Broadway Street in Albany.

Miraculously, both the drivers of both vehicles survived with minor injuries.

Lawrence McCray said he saw the aftermath of the accident and was stunned to see the cement truck sitting on top of the car.

McCray said, “I mean, just sitting at the red light just handling your daily business, and all of a sudden there is a cement truck on top of you. And you survive? That is just something alone to be grateful for.”

The driver of the AAA Concrete Products and Materials truck said that when he realized his brakes were not working, he stepped on them harder until they snapped.

The incident report said a passenger then grabbed the steering wheel, turning the truck to the right from East Oglethorpe Boulevard onto North Broadway Street.

The victim in the car said she is recovering with some pain, and at this time, she is not ready to speak about the accident.

WALB reached out to AAA for a response about the potential brake failure, but they have not responded.

APD said this accident is still under investigation.
